Terms and Conditions of Service
1) Deposit and Final Payments
1.1) All deposits are non-refundable or exchange for other services
1.2) Payment : a Deposit is required to reserve a date, the remaining as Balance and Full payment must be settled at least 30days before the date of photo session.
1.3) Bookings made less than 30days in advance, full and complete payment must be made immediately.
1.4) We can only guarantee confirmation of a photo session date once full and complete payment is received
1.5) Cancellation of booking will automatically result in the forfeiture of all deposits.
2) Amendment Fees
2.1) For changes on photo-shooting dates in the same holiday destination, there will be no handling fee so long Heartz is informed at least 30days prior to photo-shooting date. The new date must not exceed 6months from the initial photo-shooting date reserved.
2.2) A fee of S$500.00 is applicable when request for change of photo-shooting date in the same holiday destination is less than 30days from the initial photo-shooting date reserved.
2.3) A fee of S$100.00 is applicable if the new photo-shooting date exceeds 6months from the initial photo-shooting date reserved.
2.4) Change to another holiday destination will be subjected to the prevailing price offered in other packages by Heartz.
2.5) Heartz reserves and has full rights to use any photographers under its list of approved service providers and associates.
2.6) The Client is allowed to make changes ONCE. Subsequent changes will automatically result in the forfeiture of all deposits.
3) Cancellation Fees
3.1) Cancellation of booking can be made at any time. Cancellation must be made in writing.
3.2) Cancellation will result in automatic forfeiture of deposit
4) Cancellation of Booking by Company
4.1) The Company reserves the right to cancel any booking prior to the date of departure for any reasons or uncontrollable factors. In such event, Heartz shall refund in full on all deposits made. There shall be no other liabilities
5) Travel Documents
5.1) It is the Client's sole responsibility to ensure that all valid international travelling documents and proof are ready before the date of departure
5.2) The Client is also responsible for all relevant visas, exit permits for National Service, including those who are now National Servicemen or Reservists
5.3) Heartz shall not be held responsible, obligated or liable for any delays, loss of opportunity, loss of use or for any indirect losses, incidental losses, special or consequential losses or losses howsoever that might arise as a result of the Client breach in the Terms and Conditions, negligence, wilful act or default that resulted to failure to comply with the requirements stipulated in clauses 5.1 & 5.2.
6) Hotel Reservation
6.1) Where applicable, Heartz will assist in the arrangement of 1nite complimentary stay and reserves the right to select any hotel within Heartz list of approved accommodation.
6.2) Any extension or deviation of stay, other that those offered in the package by Heartz, will be born under the undersigned own expense.
7) Refund of unused services
7.1) No refunds or exchange can be made in respect of free accommodation, free tickets, free sightseeing tours, complimentary spas, concierge services or any other complimentary services whatsoever that are not utilized by the Client.
8) Insurance
8.1) We strongly recommend that the undersigned and all the members travelling together purchase their own insurance in trip cancellations, hospitalization, medical, accident prior to date of departure.
9) Responsibility and liabilities
9.1) Heartz and its associate agents act as agents for the Clients, photographers, transportation companies, accommodation companies, meal suppliers and other principals in this package. The Client/s is subjected to their respective terms and conditions under which these services are provided.
9.2) Heartz is not liable in contract or in tort for any injury, damages, lost, delays, additional expenses, or inconvenience caused directly or indirectly by events which are beyond its control or which are not preventable by reasonable diligence on its part including war, civil disturbance, fire, floods, unusually severe weather, act of god, acts of government or any other authorities, accidents to or failure of machinery or equipment or industry action.
9.3) Heartz reserves all rights to alter or modify the itineraries, travel arrangements, hotel accommodations in anyway due to circumstances over which it has no control.
10) Usage of Photographs/Prints/Images/Media
10.1) Heartz will have exclusive rights and access to use any photographs, prints, images, media as materials for marketing and online usage.
11) Location of Shoot
11.1) Heartz reserves the rights to decide, select, change any shooting sites without prior notice.
11.2) The Client/s may make request to pre-determine specific sites for shoot so long it is stipulated under the Company's list of pre-approved sites. This list is available upon request.
